How To Get The Support You Need
If you've sustained a work-related injury or illness it's important to follow the correct procedures to claim workers' compensation. Here's a step-by-step guide to assist you:

Report the Injury to Your Employer: Notify your employer about your injury or illness as soon as possible. This notification should be in writing and include details such as your name, address, age, occupation, the time and date of the injury, and a description of how it occurred. Prompt reporting ensures that your injury is recorded in the workplace's injury register.

Seek Medical Attention: Visit a doctor promptly to assess and treat your injury. Inform the doctor that the injury is work-related so they can provide appropriate documentation. During this visit, request a 'Certificate of Capacity,' which outlines your ability to work and any necessary work restrictions.

Obtain a Certificate of Capacity: This certificate, provided by your doctor, details the nature of your injury, your capacity for work, and the expected duration of any limitations. It's a crucial document for your workers' compensation claim.

Complete a Workers' Compensation Claim Form: Request this form from your employer, doctor, or directly from the State Insurance Regulatory Authority (SIRA). Fill it out thoroughly, ensuring all details are accurate and complete. Attach the Certificate of Capacity to this form.

Submit the Claim Form to Your Employer: Provide the completed claim form and the Certificate of Capacity to your employer. They are responsible for forwarding these documents to their workers' compensation insurer within seven days. Ensure you keep copies of all submitted documents for your records.

Await Insurer's Response: After receiving your claim, the insurer will contact you to discuss the next steps. They are obligated to process your claim and decide on liability within specific timeframes, typically within two months. In many cases, insurers accept claims on a 'provisional liability' basis, allowing for immediate support while they conduct further investigations.
Understand Your Entitlements: If your claim is accepted, you may be entitled to weekly payments, coverage of medical expenses, and support for rehabilitation. Familiarise yourself with your rights and the types of compensation available under your state's scheme.
